The Constitutional Implications of Online Gambling

Other laws that are relevant to online gambling include the Travel Act, which imposes a penalty for anyone who uses an interstate facility to participate in an unlawful activity. A separate act, the Lopez Amendment, regulates commercial activities. Finally, the Federal Communications Commission may also stop providing or leasing facilities. These laws have been challenged on constitutional grounds.

One of the most important constitutional objections to prosecuting illegal Internet gambling is the lack of protection for free speech. While the Commerce Clause protects against infringement of First Amendment rights, due process arguments are limited. As such, state officials have expressed concern that Internet gambling could infiltrate their jurisdictions. Several attacks have been launched, including a campaign based on the First Amendment guarantee of free speech. Yet, they have failed to gain any significant success.

There are also questions regarding the commercial nature of the gambling business. Some have argued that a commercially run gambling operation is not an “unlawful” activity under the Commerce Clause. This seems to be a valid argument because gambling is typically a transaction that is not done at a physical location. Furthermore, the Lopez Amendment contains elements that can weed out lower level gambling cases.

In the United States, there are seven federal criminal statutes that are implicated by illegal Internet gambling. Of these, the IGBA and the Wire Act are the most common, with UIGEA and Racketeer Influenced and Corrupt Organizations (RICO) provisions rounding out the list.

Interestingly, a recent report by the Government Accountability Office (GAO) outlines the problems associated with the enforcement of federal gambling laws. While the report does not discuss the infamous Rewis case, it does address some of the issues that have raised constitutional concerns.

Another issue affecting the law is the use of credit cards for placing bets. While the Federal Trade Commission has been able to prohibit a variety of illegal Internet activities, such as accepting payments for gambling, using credit cards to make bets is still illegal under the IGBA.
